When will Jersey trust cases be heard in private?

On 10 February 2009 (published 8 December 2009), the judgment In the Matter of the Representation of Sanne Trust Company Limited [2009] JRC 025A, an application for the rectification of a trust, was handed down by the Royal Court. The Court considered as a preliminary issue whether the application should be heard in private. It concluded, having considered the principles below, that unless there are exceptional circumstances, applications for the rectification of a trust must be heard in public.
