Update on Mubarak v Mubarik Jan 09The Court of Appeal's decision concerning the long-running Mubarak/Mubarik divorce litigation was published recently.
The judgment is of interest as it concerns the ambit of the Court's powers under Article 47 of the Trusts (Jersey) Law 1984 which permits the Court to vary the terms of a trust on behalf of minors, unborn and persons "whether ascertained or not, who may become entitled to an interest under the trust".
