The relationship between the beneficiaries and Caversham Trustees Limited (the ‘Trustee’) had irreparably broken down. There had been a long running fee dispute with the beneficiaries wanting to refer the fees to arbitration and the Trustees wanting an explanation as to why their fees were being disputed. The Trustees brought an application to the Royal Court under Article 47 of the Trusts (Jersey) Law 1984, as amended (the ‘Law’) seeking directions in connection with the failure to pay fees, the administration of the trust and the appointment of a new trustee.
